How to Play:

All federal, state, and local regulations apply. 2009 KS1075 “Beat The Bomb Game” (“Contest”) is sponsored by KS1075 (KQKS-FM Radio) (“Sponsor”) and jointly sponsored by any entities providing prizes.
2. KS1075 wants to give you a chance to win your share of $45, 000 in great prizes and cash with KS1075’s Beat the Bomb Game. Participants may listen to KS1075 weekdays (Monday – Friday only) beginning Monday, August 31, 2009 at approximately 7am, 9am, 1pm, 4pm and 7pm for the solicit to call. Participants must be the 10th caller to (303) 631-2448 after hearing the solicit to call as determined by KS1075. Once the participant is identified as the contestant the game will begin. The object of the game is for the contestant to say “stop” before hearing the “bomb/explosion” sound. A recorded list of various prizes will be announced during each play of the game. Each listing will be random with prizes announced during each hour of play. The participant must say stop when they hear a prize of interest or they may opt to continue playing the game for a chance to win the one of many great prizes such as gas certificate, gift certificates, Wii Game System, cash or more great prizes. However if the “bomb/explosion” sound plays before the contestant says “stop”, they automatically lose and will not receive any prizes. If a participant chooses to “stop” at any point in the game, they will automatically win the prize that was last mentioned.

In this example the contestant said stop after the $1,000 was announced prior to hearing the next prize. Thus the contestant wins the $1,000 winning the last prize that was announced.
· Example 2: $107…..Flat Screen TV….. $75 Gift certificate…… “Bomb/Explosion”
In this example the participant did not say stop before hearing the “scratch” sound was announced. Thus the participant loses and receives no prize.
These are only examples for contest clarification and do not necessarily reflect the prizes that may be given away during this contest. Total amount of Prizes given away will not exceed $45,000. Participants may continue to call in to play the came until they have won a prize. No other method of entry will be permitted. Contest is offered only to legal U.S. and Colorado residents 16 years of age or older at the time of participation. One winner per contest. Prizes are non-transferable by winners. Employees of KS1075 (KQKS-FM Radio), Lincoln Financial Media Company of Colorado, Lincoln Financial Media Company, Lincoln National Corporation, their parent, subsidiary, and affiliated companies, and their advertising or promotional agencies (collectively, the “Contest Entities”), and the immediate families or members of the same households of such individuals are not eligible. This contest is not open to other Denver metro Radio/TV station employees, and their immediate families, agencies and representatives. The term “immediate family members” include spouses, grandparents, parents, siblings, children and grandchildren. No groups, clubs, or organizations may participate in this Contest or reproduce or distribute any portion of these rules to their members. Proof of age, identity, and eligibility must be furnished to KS1075 (KQKS-FM Radio) upon request. KS1075 (KQKS-FM Radio) will not award a prize to anyone not meeting eligibility requirements at the time of entry. KS1075 (KQKS-FM Radio) reserves the right to disqualify any entrant if these Contest rules are not followed. By entering, you agree to comply with all applicable law and these Contest rules, and you agree to abide all decisions of KS1075 (KQKS-FM Radio).
4. Military Exemption Clause: In the case of Active Military (United States Armed Forces) employees, who are based in Colorado but do not claim Colorado as their official residence on their Federal/State IRS Tax Forms are exempt from the Colorado Residency clause. Active Military based in Colorado do not need to be a legal resident of Colorado, however they must be based in Colorado under their US Armed Forces orders with the expectation that they will remain in Colorado for at least 6 or more months.
5. Winners will be notified by phone, email, or mail. KS1075 (KQKS-FM Radio) is not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information. If KS1075 (KQKS-FM Radio) is unable, after making a reasonable effort, to contact a Winner, that Winner will be disqualified the prize will revert back to KS1075 (KQKS-FM Radio). The only number at which KS1075 (KQKS-FM Radio) will be accepting Contest calls is (303) 228-1075.
6. Sponsor reserves the right to substitute prizes of equal or greater value. Odds of winning depend on the number of participants. Prizes must be claimed within 2 weeks of notification. Prizes must be claimed at the KS1075 (KQKS-FM Radio) business office located at 7800 East Orchard Road, Suite #400, Greenwood Village, CO. 80111 unless otherwise specified by the staff of KS1075 (KQKS-FM Radio). To claim prizes, winners must provide a valid Colorado state issued driver’s license, state identification card, or proper military identification. In the event a winner is under the age of 18, a parent or legal guardian must tender other appropriate identification to claim the prize on the winner’s behalf. Prizes not claimed within two weeks of notification will be forfeited. Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Contest Rules, and by entering, participants agree to be bound to these Contest Rules. Any security breach or other attempt by an entrant or other party to tamper with the proper administration of the Contest will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Contest. Winners and entrants agree, except where prohibited by law, to release and discharge, hold harmless and indemnify the Contest Entities, their employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of this Contest, from any and all tax liability that may be imposed or associated with receipt or use of the prizes, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury or losses (INCLUDING PERSONAL INJURY OR DEATH) sustained in connection with the receipt, ownership, or use of the prize or while traveling to, preparing for, or participating in any Contest-related or prize-related activity. By entering the Contest or by winning, participants grant to the Contest Entities the right to publicize the participant’s name, photograph, image, likeness, voice, statements, and biographical information for advertising, trade, and promotion purposes without compensation and without opportunity for review, except where prohibited by law. Winners must execute an affidavit of eligibility and liability and publicity release. A parent or legal guardian of winners under the age of 18 will also be required to execute an affidavit of eligibility and liability and publicity release on behalf of the minor child. Winners under the age of 18 must be accompanied by a parent or legal guardian to participate in all Contest-related activities, including claiming a prize. KS1075 (KQKS-FM Radio), Lincoln Financial Media Company of Colorado, Lincoln Financial Media Company, Lincoln National Corporation retain the discretion to make all decisions regarding the interpretation and application of these rules. All decisions of KS1075 (KQKS-FM Radio) are final and discretionary. In the event the winner(s) of the prize are/is ineligible or refuse(s) the prize, the prize will be forfeited and will revert back to KS1075 (KQKS-FM Radio). The laws of the State of Colorado shall govern this Contest, without regard to Colorado’s choice of law rules. The courts of Colorado shall be the exclusive forum for any dispute relating to these Rules and/or this Contest. All participants and winners agree, by their participation in the Contest, to submit to the personal jurisdiction of the courts of Colorado. For prizes valued at $600 or greater, winner must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with prizes are responsibility of winner.
7. Disclaimer and Force Majeure. The Contest Entities, their affiliated, parent, and subsidiary companies, their employees, agents and officers, advertising and promotion agencies, and all others associated with the development and execution of this Contest are not responsible for: (1) problems associated with radio transmission, satellite transmission, phone lines, or cable lines and/or phone or IP numbers that are beyond their control—this includes, but is not limited to: a busy signal, misdirected dialing by participants, operator interference, cellular interference, technical or atmospheric conditions that disrupt the completion of a phone call, interruptions or malfunctions or for technical difficulties which may prohibit, prevent, or interfere with the transmission of radio signals to all or limited geographic areas during the playing of the Contest or that may prohibit, prevent, or interfere with the submission of an entry or completion of a phone call; (2) typographical errors in any materials relating to the Contest; (3) cancellations, postponements, or delays; (4) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of the Contest Entities, their affiliated, parent, and subsidiary companies, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the Contest or to perform under these Rules.

2. HOW TO ENTER: Beginning Wednesday, April 14, 2009 (the “Contest Period”) participants may call the KS1075 studio lines at 303-228-1075 after hearing the cue to call (the “Cue”). The Cue will air at approximately 7am, 9am, 1pm, 4pm and 7pm weekdays (Monday – Friday only) during the Contest Period. Participants must be identified at the 10th caller in order to become a contestant (“Contestant”). Once a Contestant has been selected, a snippet (of approximately 2-5 seconds) of a song from a KS1075 Summer Jam performer will be played. The Contestant will be asked to identify the Artist and the song title before the buzzer sounds. If the Contestant correctly identifies the correct 2009 KS1075 Summer Jam Artist and song title played before the buzzer sounds, the Contestant will win $1,000 and a pair of tickets to the 2009 KS1075 Summer Jam on Friday, June 12, 2009 at Fiddler’s Green Amphitheatre, pending confirmation of eligibility. Only one guess may be made. Multiple guesses will be grounds for automatic disqualification. There is no limit to the number of times a listener may attempt to call in to win, but a listener may only win once. No other method of entry will be permitted. “Time Delay Between Over-the-Air Analog Signal and Other Signal Delivery: Due to the time delay that exists between the Station’s analog and digital over-the-air signals and the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station digital or online signal may hear the cue to call later than listeners listening to Station’s analog over-the-air signal. Any dispute regarding the decisions made by the KS1075 on-air personality will be decided by the staff of KS1075 and their decision will be final. KS1075 reserves the right to determine the length of the snippet and may change the length at any time during the contest.
3. WINNER SELECTION: Total amount of prizes to be awarded is not to exceed $8,000 and 16 tickets (8 pairs). The total award amount is to be determined by the staff of KS1075. Winners will be selected in accordance with Section 2 of these Rules. If KS1075 is unable, after making a reasonable effort, to contact a Winner, that Winner will be disqualified and will not receive the prize and the prize will revert back to KS1075. Participants may only win once per contest. Odds of listener becoming a Contestant depend upon the order and number of calls received.
4. PRIZE: Each winner will receive $1,000 and a pair of tickets (two tickets) to the 2009 KS1075 Summer Jam on Friday, June 12, 2009 at Fiddler’s Green Amphitheatre. A portion of the prizes will come in the form of a company issue check that will be available in approximately 10-14 business days (not counting weekends or holidays) of winning. The staff of KS1075 will coordinate the receipt of the concert tickets. KS1075 reserves the right to delay the check process should unforeseen circumstances occur. Winners may claim their prizes by providing Colorado State Issued I.D., Driver’s License or I.D. pre-approved by the staff of KS1075. Winner will have two (2) weeks from the date of notification that the prize is available for pick up to claim their prize. Prizes must be claimed at the KS1075 (KQKS-FM Radio) business office located at 7800 E. Orchard Rd. Ste. #400, Greenwood Village, CO 80111 unless otherwise specified by the staff of KS1075.
